“កម្ពុជាប្រកាន់ខ្ជាប់នូវការគោរពសន្ធិសញ្ញានិងច្បាប់អន្តរជាតិ, អំពាវនាវឱ្យភាគីពាក់ព័ន្ធដោះស្រាយជម្លោះដោយសន្តិវិធី និងលើកទឹកចិត្តឱ្យប្រើប្រាស់តុលាការយុត្តិធម៌អន្តរជាតិ”

នៅថ្ងៃទី៣០ ខែមករា ឆ្នាំ២០២៦ ឯកឧត្តម កែវ ឈា ឯកអគ្គរាជទូត តំណាងអចិន្ត្រៃយ៍កម្ពុជា ប្រចាំអង្គការសហប្រជាជាតិ (អ.ស.ប.) បានចូលរួមកិច្ចប្រជុំ Arria Formula របស់ក្រុមប្រឹក្សាសន្តិសុខអ.ស.ប. ក្រោមប្រធានបទ «ការប្រកាន់ខ្ជាប់នូវការគោរពសន្ធិសញ្ញានានា ដើម្បីថែរក្សាសន្តិភាព និងសន្តិសុខអន្តរជាតិ» ដែលរៀបចំដោយស្ថានបេសកកម្មអចិន្ត្រៃយ៍ប៉ាគីស្ថាន នៅទីស្នាក់ការកណ្តាលអ.ស.ប. នាទីក្រុងញូវយ៉ក។

ក្នុងសេចក្តីថ្លែងការណ៍ ឯកឧត្តម តំណាងអចិន្ត្រៃយ៍ បានលើកឡើងនូវចំណុចសំខាន់ៗចំនួន៣ ដូចខាងក្រោម៖

(១) សន្ធិសញ្ញាផ្តល់នូវភាពច្បាស់លាស់ផ្នែកច្បាប់ និងការជឿទុកចិត្តគ្នាទៅវិញទៅមក ដែលមានសារៈសំខាន់សម្រាប់ទំនាក់ទំនងអន្តរជាតិប្រកបដោយស្ថិរភាព  ព្រមទាំងការថែរក្សាសន្តិភាព និងសន្តិសុខអន្តរជាតិ។

(២) កម្ពុជា មានការព្រួយបារម្ភយ៉ាងខ្លាំងចំពោះសកម្មភាពនានាដែលមានបំណងគេចវេសមិនអនុវត្តកាតព្វកិច្ចតាមសន្ធិសញ្ញាដែលមានអានុភាពគតិយុត្តិ ដោយឈរលើមូលហេតុច្បាប់នៅក្នុងប្រទេស ឬបញ្ហាក្នុងស្រុក។ រដ្ឋមួយ មិនត្រូវប្រើច្បាប់ក្នុងប្រទេសរបស់ខ្លួន ដើម្បីជាលេសបញ្ចប់ ឬដកខ្លួនចេញ ជាឯកតោភាគី ពីសន្ធិសញ្ញាដែលនៅជាធរមាននោះឡើយ។

(៣) កម្ពុជាអំពាវនាវឱ្យភាគីពាក់ព័ន្ធទាំងអស់ដោះស្រាយជម្លោះដោយសន្តិវិធី និងលើកទឹកចិត្តឱ្យប្រើប្រាស់តុលាការយុត្តិធម៌អន្តរជាតិ ព្រមទាំងអនុវត្តសេចក្តីសម្រេចរបស់តុលាការនេះដោយស្មោះត្រង់ ស្របតាមមាត្រា ៩៤(១) នៃធម្មនុញ្ញអ.ស.ប.។

“Cambodia upholds the sanctity of treaties and international law, calls on concerned parties to resolve disputes peacefully and encourages recourse to the International Court of Justice”

On 30 January 2026, His Excellency Ambassador Keo Chhea, Permanent Representative of Cambodia to the United Nations, attended the United Nations Security Council’s Arria Formula meeting on “Upholding the Sanctity of Treaties for the Maintenance of International Peace and Security”, organized by the Permanent Mission of Pakistan, at the UN Headquarters in New York.

In the statement, His Excellency Permanent Representative underscored three following points:

(1) Treaties provide legal certainty and mutual trust essential to stable international relations and international peace and security. 

(2) Cambodia is deeply concerned by practices that seek to bypass binding treaty obligations on the basis of internal law or domestic considerations. A State shall not invoke its internal law to justify the unilateral termination or withdrawal from a treaty in force. 

(3) Cambodia calls on concerned parties to resolve disputes peacefully and further encourages recourse to the International Court of Justice and the good-faith implementation of its decisions, pursuant to Article 94(1) of the Charter of the United Nations.
